AFFIDAVIT OF W. BRUCE STAUFFER
W. Bruce Stauffer, having been first duly sworn upon his oath, states as follows:
1. I am an adult resident of Marion County, Indiana, and competent to execute this affidavit, and have personal knowledge of the facts set forth below.
2. From approximately February, 1973 through October 1977, I was employed as the Executive Director of the Boone County Area Plan Commission ("APC"). In that capacity, I directed the County's Planning Department, served as a staff liaison to the APC and Board of Zoning Appeals ("BZA"), was responsible for the enforcement of the County Zoning and Subdivision Control Ordinances, help write and conduct community workshops to adopt the County Master Plan and Planning and Zoning Ordinances of 1976, and perform related duties requested by County Zoning Officials.
3. When I began my tenure as Executive Director, Terry Airport was legally in existence in Union Township and managed by Ray VanSickle, the owner of the land on which Terry Airport was and is still situated.
4. Prior to adoption of the 1976 Comprehensive Plan, it is my recollection that Terry Airport was located on land zoned A1 by which it was a legal use, most likely as an allowable Special Exception. After adoption of the County Comprehensive Plan and Planning and Zoning Ordinances in 1976, Terry Airport was permitted as an existing Special Exception in the AG District.
5. During my tenure as Executive Director, I had the duty and responsibility of overseeing the adoption of the 1976 Boone County Comprehensive Plan, along with the adoption of the Zoning and Subdivision Control Ordinances. In fact, I participated, formulated and conducted countywide public meetings held in each Township, which were necessary by law to formulate our Master Plan and adopt our Zoning and Subdivision Control Ordinances. During my employment, I actually visited the airport to understand the nature of Mr. VanSickle's operation and, in fact, was actually taken up in a plane by him to get an overall view of the airport, its facilities and the land uses surrounding the airport.
4. At no time during the formulation of the Boone County Master Plan and the adoption of our Zoning and Subdivision Control Ordinances in 1976, do I recall receiving any negative public input towards Terry Airport, its right to exist, or its right to expand and prosper.
