AFFIDAVIT OF KATHALEEN S. CLAWSON


I, Kathaleen S. Clawson, having first being duly sworn upon my oath, state as follows:

1. I am an adult resident of Boone County, Indiana and confident to execute this Affidavit, and have personal knowledge of the facts set forth below:

2. From the years 1987 through 1995, I was a secretary and assistant to Jerry March, Executive Director of the Boone County Area Plan Commission. My job responsibilities were many and varied. I answered the telephone and manned the front desk. I took and answered questions from members of the general public regarding Boone County Zoning and Subdivision Control Ordinances. I accepted and reviewed Applications for Re-Zoning, Variances, Special Exceptions, Primary and Secondary Plats and Building Permits. I coordinated and assisted in the flow of information between the Office of the Boone County Area Plan Commission and the Highway Department, Health Department and the Boone County Surveyor's Office, where I am now employed.

3. During my time as secretary and assistant to Jerry March, Ramon Van Sickle was a frequent visitor to our office. The purpose of his visit generally ranged from talking with Mr. March regarding his present and future plans for Terry Airport, along with fostering a good working relationship between himself and the Office of the Plan Commission so that those who might be applying for Building Permits for residential homes in and around Terry Airport were made aware of Terry Airport's existence. I personally observed many times Jerry March taking time when somebody applied for a Building Permit for Residential Home close to the Terry Airport to pull out the map of Union Township and point out to the applicant the fact that they were building a home in or near an Airport. Keeping the public aware of the location of this Airport was an important topic of discussion between Mr. March and Mr. Van Sickle and Mr. March made the effort to notify Building Permit Applicants of the location of Terry Airport.

4. In the many visits that Mr. Van Sickle paid to our office, I never heard Mr. March advise Mr. Van Sickle that he was out of compliance with the Boone County Zoning Ordinances. Nor, did I ever hear Mr. March advise Mr. Van Sickle that he needed a Special Exception or any other type of administrative approval for the Airport. Also, Mr. Van Sickle had had previously filed with our office a Master Plan for Terry Airport which was available to our office and members of the general public to review and inspect.
