AFFIDAVIT OF RAMON VAN SICKLE
I, Ramon Van Sickle, having first been duly sworn upon my oath, state as follows:
1. I am adult resident of Boone County, Indiana, and competent to execute this Affidavit, and have personal knowledge of the facts set forth below.
2. In 1965, I purchased the Airport now known as Indianapolis Terry Airport from the Campbell family. At the time, the Airport consisted of approximately one hundred eighty two (182) acres with a hard surface North /South runway and a turf Northeast/Southeast runway. Various improvements existed at the time of purchase including T-Hangar spaces and an Administration Building.
3. In 1966, I made an Offer to Purchase approximately forty (40) acres from Quentin Covert, who owned land immediately South of the existing North-South runway. 1, along with Quentin Covert, filed an Application for Special Exception and we were represented by Roy Martin of the firm Scifres, Hollingsworth and Martin.
4. I attended the Board of Zoning Appeals meeting of November 7, 1966 and I specifically recall that Mr. Martin advised the Board that we were there seeking a Special Exception for the Expansion of the Existing Airport by an additional forty (40) acres. I recall being advised by Mr. Martin that we needed to get approval for the expansion, and thereby approval of the Airport itself, as the original Airport predated the creation of the Boone County Area Plan Commission or Board of Zoning Appeals.
5. At the meeting on November 7, 1966, Mr. Martin made his presentation and there was no opposition. I recall Mr. Martin advising the Board that the original Airport predated the Board of Zoning Appeals existence and that we needed their approval to enlarge the Airport by forty (40) acres so to remove the existing trees on the Covert property and expand and make safer the approach to the runway. We were also proposing to build a hangar and needed a building permit for this. I remember that a member of the Board had visited the Airport and asked certain questions about my plans for expanding or improving the Airport. I remember members of the Board advising that our Request for Expansion of the Airport was approved, subject to receiving approval by the State Aeronautics Commission. This was raised because Mr. Martin mentioned that the Aeronautics Commission oversaw the actual safety requirements of the Airport, as there is nothing in the Local Ordinances that dealt with that issue. The Board also approved our request to construct the hangar and ordered the Building Commissioner to issue the permit.
6. I have continued to work directly with the Executive Directors, specifically Bruce Stauffer and Jerry March regarding improvements to Indianapolis Terry Airport. In order to make the Boone County Area Plan Commission aware of my plans for the Airport, the Whitestown Board of Aviation Commissioners sponsored the filing of the Master Plan with the County as the Whitestown Board had expressed an interest in the public use of the Airport. In my dealings with Mr. Stauffer, Mr. March and other Executive Directors or Building Inspectors, I have applied for those permits or sought approvals as suggested or requested. I relied on Mr. March's representations that, having previously received approval as a Special Exception, I needed to take no further action relative to the enlargements or improvements I was making to Indianapolis Terry Airport unless otherwise requested to do so. I have made grant applications and received monies from the State and Federal Governments in reliance of the representations that Indianapolis Terry Airport legally conformed with the Boone County Planning and Zoning Ordinances.
